Bridging Visa

about-image
Are you currently in Australia with an expired visa? If not, you might wonder what would happen if suddenly your visa validity expires. Will the authorities deport you?

A transition visa, also called a Bridging visa, allows you to remain in Australia for a temporary period until your new visa application is processed.

In short, a bridging visa is a temporary visa granted to individuals in Australia who are awaiting a decision on another visa application. It allows them to stay in the country without violating visa rules until their new visa application is approved.

What is the purpose behind applying for this visa?

You can apply for a Bridging visa for a variety of reasons such as:
  • If you are waiting for the approval of your substantive visa and your prior visa has expired,
  • If your decision on getting the new visa is pending in court,
  • If you're waiting on an Administrative Appeals Tribunal ruling about the denial or cancellation of your visa,
  • If you are going to depart from Australia legally,
  • In case you've asked for a ministerial intervention.
However, you must note that you cannot apply for a Bridging visa outside Australia. The whole purpose of this visa is to allow you to stay in Australia temporarily if you fall under any of the above categories.

Types of Bridging Visas

Well currently, five types of Bridging visas come with different entitlements and rights, such as:

  • Bridging Visa A (BVA):

This type of visa (Subclass 010) is the most common visa that allows you to stay in Australia when your substantive visa has expired. So when you have applied for the renewal of your substantive visa, you apply for this visa, too, which lets you stay in Australia temporarily.

You can submit the application form for this visa on paper or online, knowing it is free, just like you apply for your substantive visa. A BVA is granted without working rights, yet you can apply for a new BVA if you want certain working rights.

  • Bridging Visa B (BVB):

The (Subclass 020) is a Bridging visa that lets you depart and return to Australia within three months while waiting for your substantive visa to get renewed. To get BVB, you must demonstrate strong reasons to travel from Australia. If you wish to travel and have a BVA, you will be quickly given BVB.

If you ever need to travel outside Australia again, apply for a new BVB once the current one expires. In exceptional circumstances, a BVB may be given for extended periods; they are typically granted a three-month travel facility.

  • Bridging Visa C (BVC)

This (Subclass 030) visa is granted to non-Australians who have stayed in Australia for an extended period but now want to make their stay lawful. So, while waiting for their substantive visa application to be reviewed, this visa will allow them to stay in the country temporarily until a decision is made on their application.

Unlike BVB, you cannot travel in and out of Australia. You also do not get working rights with BVC. However, you can apply for a new BVC on “financial hardship” terms if you want to get certain work rights.

  • Bridging Visa D (BVD)

The (Subclass 041) is a type of Bridging Visa that allows you to temporarily extend your stay in Australia if your substantive visa has expired. This visa is limited for a very short period, say five days, for you to make the arrangements to either depart from Australia legally or apply for a valid visa.

A BVD does not give you any work rights, and you cannot apply for one. To apply for a BVD, contact our experts today, and we will assist you with the entire process.

  • Bridging Visa E (BVE)

This (Subclass 050) visa is granted to a non-citizen who came to the country unlawfully. It enables you to regain your legal status and stay in Australia while you prepare to depart, while you wait for a decision regarding a pending visa application, an application for a review, or in situations where you have requested ministerial intervention.

This visa has strict requirements. Usually, the holder must report to a Department of Home Affairs office regularly. There are restrictions on "no work" and "no study" with this visa.

Though you already know the eligibility requirements by reading the visa types, here is an overview:
