The Process for Labour Agreement 

Step 1: Enter into a Labour Agreement: 

The proposed sponsoring or nominating employer must first enter into a labour agreement with the Department by applying in accordance with prescribed requirements. If successful, the labour agreement will generally be valid for five years. If the employer has an existing labour agreement, they only need to complete steps 2 and 3.
 

Step 2: Lodge a Nomination Application:

 
The employer must submit a nomination application for the position they seek to fill, ensuring it aligns with the terms of the executed labour agreement.
 

Step 3: Employee Visa Application:

 
The proposed employee (or nominee) must independently lodge a visa application on their behalf, adhering to the terms of the labour agreement.
 

Labour Agreement Visa Requirement

Each overseas worker seeking employer sponsorship or nomination under a labour agreement must submit a separate visa application that meets all relevant requirements.
 
  • Age Requirement: The nominee must be under 45 years old.
  • Nominated Occupation: The occupation must be specified in the labour agreement.
  • English Language Skills: The nominee must demonstrate they have the minimum required English language skills.
  • Skills Assessment: The nominee must have a relevant skills assessment if specified in the labour agreement.
